The Perpetual Machine: Kalshi's Quiet War on the Oil Futures Cartel

Last Wednesday, while the world watched oil spike to $93 a barrel on the back of US strikes against Iran, a far quieter detonation was being prepared in the derivatives world. I spent that afternoon digging through CFTC filings and a familiar feeling crept over me. It was the same sensation I had back in late 2017, when I was auditing whitepapers for legitimacy rather than code, and I realized that three of the most promising ICOs had governance structures that were basically digital castles built on sand. This was different. This was the reverse. This was a well-funded, CFTC-regulated exchange preparing to launch a product that crypto natives have traded for years, but which traditional finance has always considered too volatile, too unmanageable, too alive.

People first, protocol second. Always. But what happens when the protocol is designed by a committee in Washington and the people are global energy traders? That is the question at the heart of Kalshi's audacious plan to bring perpetual futures to one of the most explosive commodities on Earth.

The Mechanism That Ate Wall Street

For those who have been living under a non-crypto rock, perpetual futures are the financial equivalent of a shark: they never sleep, they never stop moving, and they must keep swimming to survive. Unlike traditional futures contracts, which have a fixed expiration date and force traders to roll their positions forward (paying spread costs and exposing themselves to basis risk), perpetual contracts simply... continue. They are anchored to the spot price through a clever mechanism called the funding rate.

Every eight hours, longs and shorts exchange payments. If the perpetual price trades above spot, longs pay shorts. If it trades below, shorts pay longs. This creates a self-correcting arbitrage loop that keeps the contract price tethered to reality without requiring physical delivery on a set date. It is elegant, it is effective, and for the past five years, it has been almost exclusively the domain of crypto exchanges like dYdX, Bybit, and Binance.

Now, Kalshi wants to bring this mechanism to the US regulated market. But not for Bitcoin. For oil.

Here is the context that matters. Kalshi is not some fly-by-night offshore operation. It is a CFTC-registered exchange. In May, it received approval for BTCPERP, the first CFTC-sanctioned perpetual contract on Bitcoin. The product was a success by almost any measure: within five weeks, it had racked up $16.1 billion in notional trading volume. That is roughly $460 million per day, a number that would make many traditional futures exchanges blush.

The commercial logic is clear. Kalshi has already filed applications for perpetuals on precious metals, stock indices, copper, forex, and interest rates. Oil is the next logical step. In July, their Chief Risk Officer Udesh Jha publicly stated that discussions with regulators about energy products had entered an "advanced stage." Now, the plan is reportedly to submit a formal application for a WTI crude oil perpetual contract as early as next week.

This is not a revolutionary technology. Let me be clear about that. This is mechanism transplantation, not paradigm creation. The innovation here is not in the code or the consensus mechanism. It is in the regulatory arbitrage, in the audacity of asking the CFTC to approve a product that eliminates the expiry date entirely, on a physically storable commodity, in the middle of a geopolitical storm.

The Devil in the Design Details

When I look at this application, I see three technical fault lines that will determine whether this becomes a foundation stone or a cautionary tale.

First, there is the 24/5 problem. Crypto native perpetuals trade 24/7. The market never closes, because the underlying asset never sleeps. But Kalshi is requesting 24/5 trading, which means the market shuts down for the weekend. This is a compliance-driven design choice, a concession to the CFTC's concerns about risk management during hours when the traditional market infrastructure is dark. But here is the issue: oil prices do not care about the CFTC's working hours. If a drone strike hits Saudi infrastructure on a Saturday, the price will gap when trading resumes on Monday. In a perpetual contract, this gap becomes a settlement event. Without continuous trading, the funding rate mechanism becomes a blunt instrument. The arbitrage loop that keeps the perpetual price tethered to spot is broken during the weekend, and traders are left exposed to price risk they cannot hedge.

This is not an insurmountable problem, but it is a significant design compromise that CME, the world's largest derivatives exchange, was not willing to accept. In July, CME asked the CFTC for permission to extend its near-23-hour trading day for crude oil futures to nearly 24/7. The CFTC said no. The reason given was concerns about market quality and risk management. This is the regulatory landscape Kalshi is operating in. The CFTC just rejected the most powerful derivatives exchange in the world for trying to extend trading hours, and now Kalshi is asking for something far more radical: the complete elimination of the expiry date.

The key question is whether Kalshi's perpetual contract will be cash-settled or physically deliverable. For Bitcoin, this was not an issue. You cannot deliver Bitcoin to a storage facility in Cushing, Oklahoma. But oil is a physical commodity with storage costs, contango curves, and all the messy complexity of the real world. The CFTC's core concern, which has been reported, is whether a perpetual contract on a storable commodity is even conceptually sound. If there is no expiry date, there is theoretically an infinite obligation to deliver. The contract needs rules for cash settlement, forced liquidation, and position limits that do not exist in the traditional futures framework.

This is where my Financial Engineering background starts to itch. I have spent the past decade watching crypto protocols try to replicate traditional finance mechanisms, and I have seen the inverse now: traditional finance trying to absorb crypto-native mechanisms. The risk engine required for a perpetual oil contract is fundamentally more complex than anything needed for Bitcoin. Oil has a volatility profile driven by OPEC decisions, geopolitical flashpoints, and supply chain disruptions. On Wednesday, a single geopolitical event pushed prices to $93. For a perpetual contract, this means the mark-to-market engine must recalibrate in real-time, the margin system must dynamically adjust to unprecedented volatility, and the liquidation engine must be capable of handling cascading positions without triggering a death spiral.

Empathy is the ultimate security layer. But empathy does not stop a margin call.

The Market Dance: Opportunity and Predation

The market context here is nearly perfect for Kalshi. With oil trading near $93 a barrel and geopolitical risk at multi-year highs, the demand for hedging and speculative instruments is soaring. A perpetual contract offers something CME's traditional futures do not: the ability to maintain a position without rolling over. This is a genuine product improvement for traders who want to express a long-term view on oil without the hassle of monthly contract rotations.

But the competitive landscape is brutal. CME dominates the crude oil derivatives market with deep liquidity and institutional dominance. Its rejection by the CFTC is not just a regulatory setback; it is a warning shot. If the CFTC was unwilling to let CME extend trading hours, why would it allow Kalshi to fundamentally redesign the contract structure?

There is a counterintuitive argument here, and it is one I have been mulling over since I co-founded GoverningDAO during DeFi Summer. The CFTC might actually have a reason to favor Kalshi. By approving a perpetual oil contract on a smaller, more agile exchange, the CFTC can simultaneously establish a precedent for this new product type while maintaining plausible deniability if things go wrong. CME is too big to fail, which means any new product it launches is judged against systemic risk standards. Kalshi is small enough to be an experiment.

This is the regulatory arbitrage that crypto understands instinctively. The CFTC is not a monolith; it is a collection of individual decision-makers with political incentives and institutional memories. Kalshi has been strategically cultivating these relationships. The BTCPERP approval in May was not an accident. It was the result of years of engagement, of designing the contract to preemptively address CFTC concerns, of building trust in a bear market when trust is the only currency that matters.

Trust is earned in bear markets. Kalshi earned a significant chunk of it with BTCPERP.

The Liquidity Mirage and the Real Contrarian Test

Here is the contrarian angle that most market analysts are missing. The success of BTCPERP is not a reliable predictor of success for a perpetual oil contract. Bitcoin and oil are fundamentally different assets, and the trader populations are completely different. Bitcoin perpetuals are dominated by crypto-native traders who are comfortable with 24/7 markets, high leverage, and the unique risks of digital assets. Oil traders are institutional, risk-averse (relatively), and accustomed to the liquidity and transparency of CME's deep order books.

Kalshi has no native token. It cannot incentivize market makers with liquidity mining rewards or token emissions. This is a structural disadvantage. Decentralized exchanges like dYdX can bootstrap liquidity through token incentives, creating a self-reinforcing ecosystem. Kalshi must attract market makers based on pure economics. Will professional market makers commit capital to a perpetual oil contract on a relatively untested venue? The answer is unclear.

The 161 billion notional volume of BTCPERP is impressive, but it was driven by a specific moment in the crypto cycle. The same logic may not apply to oil. If Kalshi gets approval and the liquidity does not materialize, it faces the worst of all worlds: a regulated product with wide spreads, low volume, and a reputation for being a ghost town. This is the risk that the 400 billion valuation does not capture.

Let me put this in perspective. Kalshi is seeking funding at a 400 billion valuation, with plans to go public in 2027. This valuation assumes a trajectory of category expansion, revenue growth, and market capture that is aggressive by any standard. The approval of an oil perpetual is a key milestone in this narrative. If it is rejected, the narrative weakens. If it is approved but the product underperforms, the narrative weakens even more.

The CFTC's Impossible Choice

As I reflect on this regulatory tightrope, I keep coming back to the fundamental tension. The CFTC is being asked to approve a product that challenges the foundational assumptions of futures regulation. The perpetual contract's defining feature, the absence of an expiry date, undermines traditional risk management frameworks. Position limits become meaningless if positions can be held indefinitely. Margin requirements must account for tail risk events that may never resolve. The entire concept of the futures curve, which reflects market expectations of future supply and demand, becomes less relevant when there is no future date to anchor to.

This is not a technical problem. It is a philosophical one. And I have been here before. In 2022, when FTX collapsed and the crypto market entered a brutal bear phase, I watched junior developers and retail investors spiral into anxiety. But Kalshi's BTCPERP approval shows it is willing to consider new product types if the design is right.

The 24/5 design is a tell. It shows that Kalshi and the CFTC have been in deep, strategic discussions. The public comment period ended on August 26th, and the CFTC has a 45-day review window. This is not a cold submission; it is the culmination of a carefully managed engagement.

I would put the probability of approval at around 60%. The design addresses the CFTC's stated concerns, the BTCPERP precedent exists, and Kalshi has demonstrated a willingness to compromise on the 24/7 ideal. But the physical storable commodity issue is a genuine hurdle. If the CFTC approves this, it opens the door for perpetuals on wheat, gold, and natural gas. That is a significant expansion of the regulatory frontier.

The Takeaway: A Bridge or a Barrier?

What does this mean for the broader ecosystem? If Kalshi succeeds, it will prove that the perpetual contract mechanism can be institutionalized. It will become a bridge between the crypto-native derivative design and the traditional financial system. This is not just about oil trading; it is about the evolution of market structure itself. The question is whether this bridge will carry two-way traffic or become a one-way gate that siphons liquidity away from decentralized platforms.

I have been a DAO governance architect for over a decade now, and I have learned that "code is law" is a convenient myth. In reality, laws are written by people, enforced by institutions, and interpreted by courts. Kalshi is proving that the most important innovations in this space are not technological but institutional. The perpetual contract is a crypto invention, but its future may be determined not by smart contracts but by CFTC rulemaking.

I have spent my career arguing that people first, protocol second. That means we must ask who this serves. Does a perpetual oil contract on a CFTC-regulated exchange serve the oil trader who wants efficient exposure? Yes. Does it serve the retail investor who is priced out of traditional futures? Perhaps. Does it serve the vision of a truly open, accessible, decentralized financial system? Now that is the question that keeps me up at night.

The machine is being built. Let us hope the people it serves are not just the ones in the control room.
